Amity Law School, Amity University Uttar Pradesh organized the 4th Annual International Conference on Comparative Law in collaboration with School of Business and Law, Edith Cowan University, Western Australia, from 10th-11th February 2023.
Emphasizing upon the significance of studying Comparative Law, Guest of Honour Hon’ble Justice Zaki Ullah Khan, Judge (Retd.), High Court of Judicature at Allahabad, averred, “A comparative study is essential for municipal law development. Adopting a comparative approach helps to delve deeper into the legal system. to assess and appreciate the similarities and divergences amongst legislations, legal institutions, political framework, social ideologies, policies and rules in corresponding jurisdictions. This comparison may be ‘bilateral’, i.e., between two distinct legal regimes or ‘multilateral’ involving a comparative analysis of more than two legal systems, which aims at the betterment and strengthening of the domestic legal structure.”
Highlighting the purpose of Comparative Law, Hon’ble Justice S N Dhingra, Judge (Retd.), Delhi High Court, Delhi, stated, “The purpose of studying Comparative Law is to have an interaction and learn from other judicial systems. There is always a scope for improvement and Comparative Law will give an insight on how the other legal systems of the world function. Indian legal system is very old and has its roots deeply embedded in the concept of “Dharma” prescribed by the ancient sages (Rishis and Munis).”
Explaining about the four basic categories of law, Hon’ble Justice Rajesh Tandon, Judge (Retd.), Uttarakhand High Court, asserted, “Law students must study the four basic categories of law- Information Technology Act, Arbitration Law, Commercial Law and Protection of Human rights Act, since they form the basis of the judicial system of India. The conference will allow legal professionals, learned members of the academia, research scholars and students to explore, assess and compare the legal order of any two or more countries deemed suitable to them.”
Speaking during the Inaugural Session, Prof. (Dr.) Balvinder Shukla, Vice -Chancellor, Amity University, Uttar Pradesh, stated, “Indian judicial System has witnessed intense legal practice and comparative law scholarship growth in the last few decades. Global developments, transnational governance, and complex economic interdependence, aided by the development of new communication and information technologies, have contributed to making the legal profession more complex and contemporary. Comparative Law has become of tremendous significance for the growth of modern legal societies and the Conference will be highly beneficial for law students in understanding the judicial systems of other countries and influencing the policymakers of the Indian Judicial System to apply new concepts and ideologies to make it better.”
Addressing the gathering, Prof. (Dr.) D. K. Bandyopadhyay, Chairman, Amity Law School, said, “The world is recognizing Indian talent and today, the world’s greatest arbitrators are from India. Amity strongly believes in nurturing future leaders of tomorrow by applying new concepts and systems in its education pedagogy. It was one of the first institutions to adopt Education 4.0 under the NEP 2020. Due to globalization and advancement of technology, the Universe has become one family, therefore, we must learn from other judicial systems of different countries of the world and include the policies and clauses which can be beneficial for the Indian Judicial System.”
During the two-day Conference, Keynote Sessions by renowned legal experts, on various themes including “Comparative Constitutional Law”, “Comparative Criminal Law and Human Rights”, “Comparative Business Law”, “Comparative Family Law”, “Comparative IPR, Technology Law and Emerging Legal Domains” will also be organised.
On this occasion, a book on “Changing Paradigm of Law & Policy” and a journal titled, “Amity International Journal of Juridicial Sciences” was also released by the esteemed Guests and Senior Faculty of Amity.
